By signing and submitting this document, “Seller” accepts all terms and conditions for the sale of coaches through BusCentral.com, Inc.

This document is a legally binding contract. These conditions are subject to change without notice. All changes are in effect immediately. Any and all changes affecting your contract will be faxed or emailed to you within seven (7) business days. Should you not agree with any of the changes made, you have seven business days from the receipt of change notice to contact BusCentral.com, Inc. and negotiate terms that are agreeable to both parties. If an agreement cannot be reached, your coaches will be removed from the website and all sales efforts will cease. There are no refunds for listing fees and your listing fees will not change from the front of this document. Price changes can be made in writing (email is acceptable) and will not constitute a new contract. Changing between standard listings and For Sale By Owner listings will result in a new contract.

1. A completed Bus For Sale Submission Form or similar list of data is required for each coach up to and including the tenth coach. All inventory contracts covering more than 10 coaches must be written separately from this form. Please contact BusCentral.com, Inc. for more information.
2. Listing Fees must be paid in advance. American Express is accepted with an additional 5% surcharge, and wire transfers are accepted with an additional $30 accounting and documentation fee. Fees paid with a money order, cashier’s check, cash, credit card or wire transfer will be posted immediately and all listings will commence immediately. Business or personal checks may take up to 10 days to process.
3. Verification of VIN# and license information is required. A photocopy of the vehicle’s registration will take care of both. This information will not be provided to anyone without your express written consent. This information may or may not be researched, at BusCentral.com, Inc.’s discretion and expense. ALL FINDINGS WILL BE SHARED WITH THE SELLER AND NO INFORMATION WILL BE MADE PUBLIC.
4. BusCentral.com, INC. WILL ALWAYS SHARE INFORMATION WITH LAW ENFORCEMENT, COURTS OR RELATED AGENCIES AS REQUIRED AND DIRECTED BY LAW. BusCentral.com, INC. MAY TERMINATE LISTINGS IF THE VALIDITY OF YOUR SALES LISTING(S) IS IN DISPUTE BY ANY SUCH LEGALLY RECOGNIZED ORGANIZATIONS.
5. All coach listings MUST include at least 2 photos; one interior and one exterior. For best results, please send actual photos via regular mail or send high-resolution digital photos via email. They will be scanned and returned to you. In order to avoid delays, all photos should be labeled clearly and concisely. LISTINGS WITHOUT PHOTOS MUST BE UNDER FOR SALE BY OWNER CONTRACT.
6. BusCentral.com, Inc. is a licensed used motor vehicle dealer in the state of Tennessee. As such, certain limited liabilities MAY BE covered when your coach is displayed and brokered from our sales lot. Internet-only listings do not have any coverage of any kind. In no case is any physical damage covered. No exceptions. WE DO NOT PROVIDE INSURANCE AND YOU WILL NEED TO CARRY YOUR OWN INSURANCE. IN NO WAY WILL ANY EXPRESS, IMPLIED, OR OTHER STATEMENT OF INSURANCE COVER ANYTHING NOT EXPRESSLY COVERED IN OUR GARAGE POLICY. NO EXCEPTIONS. BusCentral.com, INC. IS NOT RESPONSIBLE FOR YOUR COACH, ITS CONTENTS, ETC. FOR ANY REASON.
7. All coaches are sold as-is, where is, with no warranties express or implied. An addendum to this contract may be created if seller wishes to provide warranty or guaranty. Two copies of said warranty must be supplied to BusCentral.com, Inc. upon listing of the vehicle.
8. A sales commission of 8% is due to BusCentral.com, Inc. upon the successful sale of any vehicle being brokered by BusCentral.com, Inc. and / or when sold to a BusCentral.com, Inc. lead/buyer.  The commission rate is noted on the front page of this contract and cannot be changed unless submitted and accepted, in writing, by both parties and added as an addendum to this contract.

   A BusCentral.com, Inc. lead/buyer is any person that is introduced to seller by BusCentral.com, Inc., related company, services or related property. AS A LICENSED DEALER, ALL SALES ARE AUDITED AND A COPY OF ALL FINAL DOCUMENTATION MAY BE REQUIRED BY BusCentral.com, INC. FOR PROOF OF SALE ORIGINATION. FAILURE TO SUBMIT INFORMATION IN RESPONSE TO OUR AUDIT MAY RESULT IN SELLER BEING BILLED FOR COMMISSION AND RELATED RECOVERY FEES.

9. You agree, without exception, that BusCentral.com, Inc. is only a broker, a marketplace, a venue, a marketing tool.
10. You agree, without exception, that BusCentral.com, Inc. is not liable for any damages, material, monetary or otherwise, regardless of amount or incident as they relate directly or indirectly to the sale of your coach.
11. You agree, without exception, that BusCentral.com, Inc. cannot and will not be held liable for any issues, damages, incidents or other problems as they relate to the sale of your coach either directly or indirectly.
12. You agree, without exception, to indemnify and protect BusCentral.com, Inc. against any and all legal proceedings, regardless of nature, as they may arise in relation to the sale of your coach either directly or indirectly.
13. You agree, without exception, that BusCentral.com, Inc. is not to be held responsible in any way for information provided by the seller, regardless of error, and that BusCentral.com, Inc. is only a medium for displaying that information.

    SELLER CAN CHANGE THE PROVIDED INFORMATION AT ANY TIME, WITHIN REASON, AT NO ADDITIONAL COST. EXTREME CHANGES TO SALES INFORMATION MAY RESULT IN THE LISTING BEING PULLED FOR EVALUATION BEFORE CHANGES ARE MADE AND THE ITEM IS RELISTED. ALL CHANGES ARE AUDITED TO ENSURE TRUE AND CORRECT INFORMATION TO THE BEST OF BusCentral.com, INC.’S KNOWLEDGE

14. BusCentral.com, Inc. may expire any listing at their discretion should any of these rules, statutes and requirements go unheeded. BusCentral.com, Inc. will always give seller notice, in writing, when it believes a listing or seller breaks any part of this contract. IF SELLER CANNOT BE REACHED VIA PHONE, EMAIL, MAIL, ETC. AFTER REAL EFFORTS HAVE BEEN MADE AND DOCUMENTED BY BusCentral.com, LISTING MAY BE EXPIRED. RELISTING MAY RESULT IN A NEW CONTRACT AND NEW FEES.
15. For all purposes, email is an acceptable form of communication. Anything requiring a return receipt, signature, or verifiable delivery should be sent via USPS Express Mail, Federal Express, or other, comparable, traceable delivery.

All fees collected of any type are NON-refundable.

Shortly following submission of this document, the “Seller” will be contacted by a representative of BusCentral.com, Inc. with particulars about the listing, including the assignment of Stock Number, an estimated date for the listing to begin (including a unique page on the internet), and any related financial matters.
